Debevoise & Plimpton LLP has advised Rolls-Royce plc (“Rolls-Royce”) in its Leniency Agreement with Brazil’s Office of the Comptroller General (“CGU”), which was approved on October 26, 2021.
Debevoise was engaged by Rolls-Royce in early 2012 to lead internal investigations into the historic use of intermediaries, and advised on the company’s 2017 coordinated global resolution with the UK’s Serious Fraud Office, the Brazilian Ministério Público Federal (“MPF”), US Department of Justice (“DoJ”) (see full detail).
Since 2017, Debevoise has continued to advise Rolls-Royce in Brazil, jointly with Antenor Madruga and Ana Belotto of Brazilian firm Feldens Madruga, in response to enquiries made by the CGU in relation to the same conduct as that covered by the 2017 Leniency Agreement signed with the MPF, and that formed part of the Deferred Prosecution Agreement with the DoJ.
Debevoise and Feldens Madruga also advised on the subsequent negotiations with the CGU, leading to the latest Leniency Agreement.
