Debevoise & Plimpton LLP and the Center for Reproductive Rights (CRR) recently defeated Louisiana’s motion to dismiss a comprehensive substantive due process challenge to the state’s TRAP laws. Last year, Debevoise and the CRR filed a lawsuit against the state of Louisiana’s abortion clinic licensing law that has since forced all but three clinics in the state to close.
The suit challenges the state’s licensing and regulatory regime which includes medically unnecessary provisions that place undue burden on access to abortion. The Court, in deciding to move the suit forward, noted that the state may not “attack abortion providers in a death-by-a-thousand cuts strategy.”
