Debevoise partner and co-head of the firm’s Global Infrastructure and Project Finance Group Ivan E. Mattei explained to Law360 that the administration’s Legislative Outline for Rebuilding Infrastructure in America contains some provisions that may pique the interest of private equity investors. For example, Mr. Mattei discussed how modifications to the FAA’s airport privatization could be quite appealing, “’In the past, the need to obtain supermajority approval of the airlines that use an airport proposed to be privatized has given such airlines leverage over the negotiation of economic terms that has made it difficult for some deals to progress,’ Mattei explained. ‘There are many other examples of seemingly small adjustments in federal regulation and financing programs that could lead to significant transactions of interest to PE and other infrastructure investors.’”
