As part of The Asia-Pacific Arbitration Review 2024, published by Global Arbitration Review, our team has contributed a chapter focusing on investment treaty arbitration in the Asia-Pacific region.
In the first study of its kind, the chapter surveys all publicly available investment treaty claims that have been pursued against Asia-Pacific states. In so doing, the chapter identifies states that have faced claims, the industries concerned, and the outcomes of these claims, including the dismissal of claims on jurisdictional grounds. The chapter also provides a brief overview of the region’s investment treaties and the nature of investment treaty claims that have been pursued by investors against Asia-Pacific states. As is illustrated, a diverse range of Asia-Pacific states have now faced investment treaty claims across a variety of industries and several states have taken steps to limit the potential for future claims.
